“U.S. Tied Migrants to Gang Based Largely on Clothes or Tattoos, Papers Show,” New York Times, March 31, 2025 The Trump administration has granted itself the authority to summarily deport Venezuelan migrants based on little more than whether they have tattoos or worn clothing associated with the violent Tren de Aragua gang, according to court papers. In March, the Trump administration ordered more than 100 people to be deported based on suspicions they were members of Tren de Aragua. It did so under the powerful wartime statute the Alien Enemies Act. Use of the measure meant they were denied any due process to challenge the allegations against them. The court papers, submitted by lawyers for the Venezuelan migrants, included a U.S. government document entitled “Alien Enemy Validation Guide.” It laid out criteria officials must meet to designate people as members of Tren de Aragua.
